STANDARD OPERATING PRACTICES

Effective October 2025 – Pursuant to New York Real Property Law § 442-h

At SOCIETE REAL ESTATE, professionalism, discretion, and integrity guide every client relationship. To ensure a seamless experience and full compliance with New York State law, all new client engagements begin with a verification and qualification process.

 

1. REQUIRED DOCUMENTATION

Prior to engaging in the purchase, sale, or lease of property, all clients must provide up-to-date documentation verifying identity and financial readiness. This includes, but is not limited to: 

  • Two (2) valid forms of identification are required. Acceptable forms include:
    • A government-issued photo identification (e.g., driver’s license or passport), and
    • One of the following secondary forms of identification:
      • A verified public social media profile that reflects the same legal name; or
      • A verifiable professional reference who can confirm identity and relationship
  • Recent proof of funds and/or mortgage pre-approval letter from a financial institution
  • Banking, stock, or bond statements (if relevant)
  • Employment or financial accounting letters confirming income or assets
  • Tax returns (two most recent years or as requested for verification)
  • Proof of home ownership for any property being sold

All brokerage relationship agreements, disclosure forms, and agency representation agreements must be fully executed prior to representation. Clients must also comply with all building management or ownership requests that arise during a transaction.

 

2. ENGAGEMENT CRITERIA

Our brokerage is selective about representation to maintain the highest quality of service and alignment of values. We may decline representation in cases where:

  • There is a personality or communication mismatch that prevents effective collaboration;
  • The client’s goals fall outside our market expertise or price-point specialization;
  • The client’s financial profile involves unusually complex structuring that extends beyond our brokerage model; or
  • The individual agent’s availability is limited.

These determinations are made solely on the basis of professional alignment, logistics, and capacity, never based on discrimination or bias.

It is presumed that any prospective buyer or renter presented by a broker has been duly vetted and qualified by such broker. In the event a prospective buyer or renter approaches the listing without broker representation, SOCIETE REAL ESTATE reserves the right, as a condition precedent to any showing, to require production of documentation reasonably necessary to verify such buyer or renter’s financial capacity and eligibility to purchase or lease the property. Such documentation may include, without limitation, a lender pre-approval letter, REBNY financial statement, or income verification letter.

4. PRIVACY & DATA SECURITY 

All documents provided are treated as confidential and are collected solely for qualification and compliance purposes.

We maintain industry-standard security measures to protect client information and do not disclose personal or financial materials to third parties without written consent, except as required by law.

 

5. SOP POSTING & RECORDKEEPING 

In accordance with New York State law, these Standard Operating Practices are publicly available on our website and at our office upon request.

SOCIETE REAL ESTATE maintains a dated and notarized record of all versions of this policy. Any material changes will be posted within 30 days of revision and archived for the duration of the brokerage’s active license.
